DC 31 is pretty crazy.  Mael can reach it, but not without a prep round. (And you got an encounter already, so you shouldn't doubt your usefulness. This is actually Mael's first!  )

Obviously flying is always an issue in D&D, but because the game is like it is I guess it's a bigger issue.

I know, just got to up that armor a bit more, to easy to be hit right now. Sadly it seems my first problem is getting flight...19k...  Next armor upgrade was going to be ~2000 gold, followed by ~23000, though that last helps the whole party. By level 12 I would need to spend another ~2000. Somewhere before level 13 I need to pay for my legacy… Now before all of that I have to get flight… So many expenses.

Ok, just wanted to say, I didn't attack Torgthen without a reason. He's a VERY survivable character, and I'm sure he can take it, so far. Someone will just have to prevent these things from finishing the job next round. That's what's a team is all about. (Yeah, you're in no way a coherent team, I know, but that doesn't mean that you can't help him.)
If all else fails, there's still Devanar.
