ELH was never updated in 3.5 form, unless it was in like the Rules Compendium or something. So it's as legit as you're going to get.
...3.5 update booklet on the Wizard website? Anything unmodified by the update booklet is as it was printed in the ELH.

I just realized as I was making example NPC's for these: they don't have official Epic levels for the Alienist, Beguiler, or Dread Necromancer do they?
And if they don't how does the following sound?
EPIC ALIENIST
Hit Die:
d4
Skills Points at Each Level
: 2 + int
Spellcasting
The Epic Alienists Caster level is equal to her class level. Her number of spells per day does not increase after 20th level, but each new level she gains she can learn 2 new spells of any level she can cast.
Familiar
The Epic Alienists Familiar continues to increase in power. Every 2 levels higher than 20th the Familiar's Natural Armor Bonus and Intelligence increase by +1. The Familiar's Spell Resistance is equal to the Master's Level+5. At 21st level and every 10 levels higher the Familiar gains the benefits of the Familiar Spell Epic Feat for a spell of it's Master's choice.
Bonus Feats
: The Epic Alienist gains a Bonus Feat every 3 levels higher than 20th
EPIC DREAD NECROMANCER
Hit Die:
d12
Skills Points at Each Level
: 2 + int
Spellcasting
The Epic Alienists Caster level is equal to her class level. Her number of spells per day does not increase after 20th level.
Scabrous Touch
The Epic Dread Necromancer gains 1 more daily use of it's Scabrous Touch at level 21 and every 5 levels higher.
Negative Energy Burst
The Epic Dread Necromancer gains 1 more daily use of it's Negative Energy Burst at level 23, and every 5 levels higher.
Advanced Learning
The Epic Dread Necromancer gains a new spell via their Advanced Learning ability at 23rd level, and every 4 levels higher.
Rebuke Undead
Use the Dread Necromancer's class level to determine the most powerful undead affected by a rebuke check and the turning damage just as normal.
Familiar
The Epic Dread Necromancers Familiar continues to increase in power.
Bonus Feats
: The Epic Dread Necromancer gains a Bonus Feat every 5 levels higher than 20th.
EPIC BEGUILER
Hit Die:
d6
Skills Points at Each Level
: 6 + int
Spellcasting
The Epic Beguilers Caster level is equal to her class level. Her number of spells per day does not increase after 20th level.
Advanced Learning
The Epic Beguiler can learn a new spell via their Advanced Learning ability at level 23 and every 4 levels higher.
Bonus Feats
: The Epic Beguiler gains a Bonus Feat every 3 levels higher
than 20th
And does the Dread Necromancer actually gain the Lich Template, or just whats listed in it's class ability?

This has been argued to death. It's pretty clear RAI that he becomes a lich, because it mentions that he doesn't have to pay for the phylactery, or whatever it was. But RAW, I don't think he does.
